TERMS AND CONDITIONS FOR JAMS ACADEMY

The following Terms and Conditions apply to all lesson agreements made between JAMS Music Academy (“JAMS”) and its pupils and the parents / guardians of its pupils (“the pupil”).

The Terms and Conditions described below have been discussed at length amongst the JAMS leadership team with the endeavor of making them as fair as possible for both client and provider. As JAMS is a social enterprise that functions with minimal margins, such lines in the sand have had to be drawn. We try to approach each individual case in good faith with an open ear, and we hope that you will also approach us in the same manner. There will be times that the terms and conditions are more in favour of JAMS, but there are also other times that they are more in favor of the student/caregiver.

1. Term Dates
1a. Teaching weeks at JAMS are year round. We are closed for 4th of July, Memorial Day, Labor Day, Thanksgiving Break, Christmas Break and other occasional holidays. We do not give make ups for these days. We also don’t pro-rate for this, but we don’t charge extra for 5-week months.

2. Communications
2a. All correspondence is sent out to the pupil by email. If this causes a problem, please let JAMS know.

2b. It is the responsibility of the pupil to make JAMS aware of any changes to their contact details. JAMS will not be held responsible for any missed communications, late / overdue payments, missed lessons, etc. if this is due to incorrect contact information.

3. Timetabling of Lessons

3a. The pupil will be informed of the lesson day, time and the date of their first lesson before their teaching commences, either by phone, in person or by email. JAMS will aim to confirm all the lesson details by email, but does not guarantee that this will be the case if it deems sufficient confirmation has been provided by other means.

3b. Site-based/virtual lessons - if the agreed lesson times or days need to be changed, the pupil will be contacted as far in advance as possible and alternative arrangements will be made to continue the lessons at times and days that suit the pupil and JAMS.

4. Absences/Tardies

4a. Individual lessons –

4.a.i. If the pupil is unable to attend a lesson please let JAMS know at the earliest time possible, via email at jamsacademylesson@gmail.com. Please give a 24-hour notice.

4.a.ii. If a student is unable to attend a scheduled lesson due to extenuating circumstances such as illness or any other unforeseen event, a pre-recorded lesson will be made available to ensure continued access to educational materials and instructional content.

4.a.iii If a student is more than 10 minutes late for their studio/online lesson, it will be considered tardy, and a pre-recorded lesson will be provided.

4.a.iv If a student fails to attend 2 or more music lessons in a month without providing any prior notice, they will be charged a $25 fee for the missed session. This fee will be added to their next invoice. The fee is non-refundable and non-transferable. Exceptions to this policy may be made for emergency situations, but must be discussed and approved by the music tutor in advance.

4b. Tutor Absences –
4.b.i. If the pupil's tutor is unavailable to teach, JAMS will attempt to arrange a cover tutor and give you as much notice as possible.

4.b.ii. If this is not possible, the pupil’s normal tutor will arrange catch up lessons with the pupil as stipulated in 4.a.ii.

4c. Unavoidable cancellations –
4.c.i. If JAMS cancels any lessons due to events out of its control, customer credit may be given

at the discretion of JAMS management.

4d. Ongoing absences –
4.d.i. If a pupil will be absent for more than three weeks due to medical reasons, a credit may be given, at the discretion of JAMS management.

4e. Group Lesson Absences-

4.ei. Due to the nature of group lessons, we do not offer makeups if a student is absent.

5. Duration of the Lesson Agreement - ongoing
5a. The lesson agreement between JAMS and the pupil is a rolling agreement that continues

into each new term and new year.

5b. The pupils are emailed their invoices towards the end of each month in respect of the following term’s lessons, until a cancellation notice is received, as discussed below.

6. Cancelling the Lesson Agreement – the pupil must opt out of the Lesson Agreement with JAMS

6a. If the pupil wishes to cancel the lesson agreement with JAMS, written notice must be received by JAMS Management at least two weeks prior to the intended last lesson at jamsacademylesson@gmail.com. Any lessons remaining after the end date will be credited to the pupil's account if payment has already been made.

6b. Verbal notice given to the tutor will not be acted upon and is not considered sufficient unless confirmed in writing to JAMS main office by the pupil.

6c. If the pupil is unable to give two weeks’ notice, they will be charged a late notice fee equivalent to two weeks of lessons.

6d. Exceptions on medical grounds may be made to this as decided by JAMS management.

6e. If JAMS has to cancel a lesson agreement it will endeavour to give two weeks’ notice to the pupil. Any lessons remaining after the lessons’ end date will be credited to the pupil's account if payment has already been made.

6f. If, in exceptional circumstances, JAMS has to cancel the pupil's lesson due to damage of JAMS property or harassment of JAMS staff by the pupil, this may be done with no notice and no credit or refund for any outstanding lessons.

7. Payments at JAMS

7a. Payment is to be received before the initial lesson and within 15 days after your invoice is sent in subsequent lesson cycles. Invoices are emailed on the 15th of each month.

7b. ZELLE-payments may be made via zelle using the email jamsacademylesson@gmail.com

7c. DIRECT DEBIT- Please complete our JAMS Authorization form

7e. ACH -payments may be made via debit or credit cards using your invoice. There is a 2.9% fee.

7f. A $15 fee will be incurred on the 16th day after your invoice has been sent if payment has not been received.

8. Tuition Fees and Accounting
8a. JAMS starts following up term fees with an assumption of good faith that it is an unintentional mistake.

8b. The pupil will be billed for each future lesson cycle on the 15th of each month.

8c. New pupils will receive an invoice when their enrollment is processed.

8d. A discount of 15% will be applied to all lessons where three or more individual lessons/activities are attached to a single family record on the JAMS database. This discount will not be applied retrospectively for any lessons already billed.

8e. Refer a Friend Discount- For every person you refer to JAMS that books a 4-session package, the pupil will receive a prize.

8f. Penalties for late payments will be applied as per the below terms.

9. Penalties

9a. LATE PAYMENT -A $15 fee will be incurred on net 16 (16 days after an invoice is emailed) if payment hasn’t been received.

9b. The pupil is responsible for any and all charges that their bank may levy for rejecting any payment to JAMS.

9c. JAMS does reserve the right to temporarily and fully suspend pupils from lessons with unpaid term fees during term time. A temporary suspension means that JAMS will keep the lesson timeslot available for the pupil in the hopes that payment will be made. A full suspension means that JAMS has the right to fill the pupils lesson time slot with another pupil from the waitlist.

10. Photography & Filming

10a. JAMS owns and reserves the right to use any film/media/still photographs of students for appropriate promotional purposes both in the US and overseas, this also includes for use in Social Media.

10b. You (or your parents if you are under 18 years of age) must inform JAMS in writing at anytime if you will not allow the use of such images.

11. Changes to the Terms and Conditions

11a. The Terms and Conditions described above are agreed to upon enrollment and may be changed at any point by JAMS without providing notice to the pupil. A copy of the Terms and Conditions will always be available on our website and may be emailed to the pupil on request.
